CHAPTER XI. PUBLIC OFFENSESCHAPTER XI. PUBLIC OFFENSES\ARTICLE 1. UNIFORM OFFENSE CODE

There is hereby incorporated by reference for the purpose of regulating public offenses within the corporate limits of the City of Satanta, Kansas, that certain code known as the “Uniform Public Offense Code for Kansas Cities”, 40th Edition of 2024, prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas, save and except such articles, section, parts or portions as are hereafter omitted, deleted, modified, or changed. No fewer than three (3) copies of said Uniform Public Offense Code shall be marked or stamped “Official Copy as Adopted by Ordinance No. 428,” and to which shall be attached a copy of this article or said ordinance, and filed with the City Clerk to be open to inspection and available to the public at all reasonable hours. The Uniform Public Offense Code currently adopted by the City shall be amended or supplemented, as the case may be, by all other sections contained in this chapter, regardless of whether such other sections were adopted before or after the current Public Offense Code.

(a)   EXCEPTIONS. Certain ordinances relating to public offenses in the City of Satanta, Kansas, including but not limited to the following, are not superseded, replaced, or repealed by the adoption of the Uniform Public Offense Code for Kansas Cities; and these ordinances are hereby re-enacted, reinstated, reordained, and retained in addition to the Uniform Public Offense Code for Kansas Cities:

(1)   Ordinance No. 214 - A ORDINANCE REGULATING THE USE OF CITY PARKS, AND PROVIDING FOR AND RESTRICTING THEIR USE BETWEEN CERTAIN HOURS OF THE DAY AND NIGHT AND PROVIDING FOR PENALTIES FOR VIOLATION THEREOF.” Passed September 5, 1979.

(2)   Ordinance No. 280 - “AN ORDINANCE ESTABLISHING HOURS OF CURFEW APPLICABLE TO SPECIFIED AGE GROUPS; ESTABLISHING PROHIBITIONS AGAINST PARENTS AND OTHERS WHO MAY PERMIT SUCH VIOLATIONS OF CURFEW; AMENDING AND ADDING TO THE UNIFORM PUBLIC OFFENSE CODE; AND PROVIDING FOR PENALTIES FOR VIOLATIONS THEREOF.” Passed October 5, 1993.

(3)   Ordinance No. 294 - AN ORDINANCE ESTABLISHING POLICIES AND PROCEDURES WITH RESPECT TO PEDDLING, SOLICITING, CANVASSING, AND SELLING WITHIN THE CITY LIMITS OF SATANTA, KANSAS, REQUIRING REGISTRATION OF CERTAIN PERSONS AND ESTABLISHING BUSINESS REGULATIONS FOR SUCH PERSONS AND PENALTIES THEREFORE.Passed December 4, 1996.

(4)   Ordinance No. 299 “AN ORDINANCE PROHIBITING THE KEEPING OF PIT BULL DOGS, WILD AND EXOTIC ANIMALS, AND VICIOUS DOGS, CATS, AND ANIMALS OF ANY KIND IN THE CITY OF SATANTA, AND PROVIDING FOR FINES AND PENALTIES IN VIOLATION OF THIS ORDINANCE.” Passed November 5, 1997.

(5)   Ordinance No. 302 – “AN ORDINANCE AUTHORIZING THE DECLARATION OF A WATER WATCH, WARNING, OR EMERGENCY; ESTABLISHING PROCEDURES VOLUNTARY AND MANDATORY CONSERVATION MEASURES; AUTHORIZING THE INSURANCE OF ADMINISTRATIVE REGULATIONS; AND PRESCRIBING CERTAIN PENALTIES.” Passed 1999.

(6)   Ordinance No. 311 – “AN ORDINANCE REGULATING CERTAIN NOISES AND LOUD SOUNDS WITHIN THE CITY LIMITS OF THE CITY OF SATANTA, KANSAS IN ADDITION TO THE UNIFORM PUBLIC DEFENSE CODE FOR KANSAS CITIES AND PROVIDING FOR PENALTIES FOR VIOLATION THEREOF.” Passed June 6, 2012.

(7)   Ordinance No. 329 – “AN ORDINANCE PROVIDING FOR THE CUTTING OR DESTRUCTION OF ALL GRASSES, WEEDS, AND VEGETATION IN EXCESS OF 12 INCHES IN HEIGHT 0 LOTS OR TRACTS OF LAND WITHIN THE CITY OF SATANTA, KANSAS AND PROVIDING THAT THE COSTS MAY BE ASSESSED AGAINST THE LOT OR PIECE OF LAND.Passed July, 13, 2005.

(8)   Ordinance No. 336 – “AN ORDINANCE AUTHORIZING SUNDAY SALES OF ALCOHOLIC LIQUOR AND CEREAL MALT BEVERAGE IN THE ORIGINAL PACKAGE WITHIN THE CITY OF SATANTA, KANSAS.” Passed April 3, 2006.

(9)   Ordinance No. 340 – “AN ORDINANCE REGULATING THE LOCATION AND SPACING OF MOBILE HOMES AND PROVIDING FOR PERMITS TO LOCATE MOBILE HOMES, AND CREATING MOBILE HOME PARKS AND LICENSING OF THE SAME.” Passed on November 1, 2006.

(10) Ordinance No. 345 – “AN ORDINANCE RELATING TO THE TAXATION AND LICENSING OF DOGS, PROVIDING FOR THE CAPTURE AND IMPOUNDMENT OF DOGS, PROVIDING FOR THE DESTRUCTION OF UNLICENSED DOGS, PROVIDING FOR FINE AND PENALTIES FOR VIOLATION OF THIS ORDINANCE.Passed June 4, 2006.

(11) Ordinance No. 353 – “AN ORDINANCE DEFINING NUISANCES IN THE CITY OF SATANTA KANSAS AND PROVIDING FOR PROCEDURES FOR ENFORCEMENT OF VIOLATIONS.” Passed May 5, 2010.

(b)   EXEMPTIONS.

(1)   UNIFORM PUBLIC OFFENSE CODE SECTIONS 9.9.1 REGULATING UNLAWFUL POSSESSION OF MARIJUANA THROUGH 9.9.6 DISTRIBUTION OF A NON-CONTROLLED-SUBSTANCE NOT APPLICABLE. Due to the serious nature of these types of offenses and implications of the same, the City acknowledges that these offenses have historically been charged in district court and finds that said offenses should continue to be charged in district court. Wherefore, the City hereby exempts itself from Sections 9.9.1 through 9.9.6 of the Uniform Public Offense Code and amendments thereto which regulate certain illegal substances and paraphernalia.
