As used in this article the following terms will be deemed to have the meanings set forth:
(a) Natural gas supplier - any person, firm, partnership or corporation which furnishes, sells, distributes or otherwise supplies through underground pipelines natural gas to consumers within the City of Satanta.
(b) Franchise - a person, firm, partnership or corporation which is granted authority for the supplying or distribution of natural gas within the City of Satanta as authorized by K.S.A. 12-2001 et seq. and City Ordinance.
(c) Consumers - persons, firms, partnerships or corporations who are supplied natural gas for residential, business, commercial or any other use within the City of Satanta, Kansas.

It shall be unlawful for any natural gas supplier to furnish sell, distribute, or otherwise provide or supply natural gas to consumers within the City of Satanta, Kansas, unless such natural gas supplier shall first obtain and hold a franchise from the City of Satanta pursuant to the provisions of K.S.A. 12-2001 et seq.

The City of Satanta, Kansas hereby adopts by reference the Pipeline Safety Regulations, Parts 191 and 192, Revised Edition of October 1, 1982 as promulgated by the United States Department of Transportation and adopted by the Kansas Corporation Commission. All pipelines installed by or used by natural gas suppliers within the City of Satanta, Kansas shall be installed and maintained in conformity to said regulations.

No franchise to supply natural gas to consumers within the City of Satanta shall be granted unless such applicant for franchise shall guarantee that it will provide natural gas on a non-discriminatory rate basis to all similar users who may request to obtain natural gas for use within the City of Satanta.

No per son, firm, partnership or corporation, other than natural gas suppliers holding a franchise shall construct or maintain natural gas pipelines across or under City streets, alleys or City property. Provided, however, such prohibition shall not apply to pipelines laid or constructed to transport natural gas from a franchised natural gas supplier pipeline lying within a City street, alley, or City property and connected to a natural gas consumer’s property.

Any person, firm, partnership or corporation who violates the terms of this article shall be subject to a fine of not less than $50.00 nor more than $500.00. Each day a violation continues shall be deemed a separate violation.
