It shall be unlawful for any person, firm, association, corporation, or custodian (hereafter referred to as owner) to keep or harbor within the city limits of Satanta, Kansas, any dog over the age of 3 months, without causing such dog to be licensed, and paying the license tax, as hereinafter provided.

(a) There is hereby levied an annual tax upon the owner of any dog within the city limits as follows:
(1) For each male or spayed female dog: $6.00
(2) For each female dog not spayed: $8.00
(b) Each owner keeping a dog over the age of 3 months shall pay the tax imposed by this article to the City Clerk of the City of Satanta, Kansas, within ten (10) days of the dog turning 3 months of age, or within ten (10) days after acquiring ownership or possession of any dog subject to licensing hereunder, or within ten (10) days after establishing residence within the city of Satanta, Kansas. The full amount of the annual license tax shall be required regardless of the time of year such application is made. All licenses shall be valid for a 1 year period of time and shall be renewed every year thereafter with the City Clerk of the City of Satanta.”
(c) All owners of dogs shall furnish the City Clerk of the time of application for a dog license, a certificate from a licensed veterinarian showing said dog to have been immunized against rabies and that such immunization will remain effective for the entire year for which the dog is to be licensed and taxed.

Upon proof of Rabies vaccination by a licensed veterinarian, and upon payment of the tax herein imposed, the City Clerk shall issue a receipt to the owner and shall supply the owner with a dog tag. It shall be the duty of the owner to cause the tag to be affixed to the collar of the dog for which the tag has been paid and issued, and in a manner that said tag may be easily seen and observed by city officials. In case of a lost tag, the City Clerk, upon application and satisfactory proof of prior registration and loss, and upon payment of the sum of $1.00 shall issue a replacement tag.

The City Clerk shall keep a book in which shall be entered the name and address of the owner paying tax on dogs, the name of each dog, it’s sex, and if female, whether spayed or not.

(a) Any unlicensed dog, whether in control and possession by the owner/custodian or if running at large may be impounded. Any dog, whether licensed or unlicensed, which is off the owner’s property without a leash, (or in violating section 2-107 dogs prohibited acts & 2-202 pertaining to vicious dogs) may be impounded. The City Law Enforcement Agency and/or the City’s authorized designee including, but not limited to City employees, shall have the authority to impound dogs. All dogs taken into custody and impounded by the City of Satanta for a violation of this article shall be held for a period of up to, but not more than, 3 full business days. Dogs impounded shall be released to the owner upon verification of ownership, proof of rabies vaccination or by paying a $50.00 rabies deposit if the dog is not vaccinated, purchase of a license if said dog is unlicensed, upon paying the impound fee, and paying the kennel fee if applicable. In the event the dog(s) does not have its rabies vaccination, then the owner shall pay a $50.00 rabies deposit per dog to the City; said deposit will be reimbursed to the owner so long as the owner provides proof of rabies vaccination to the City within 30 days of release of the dog. In the event the owner fails to present proof within 30 days of release, then said $50.00 deposit will be surrendered and become the property of the City. The impound fee for a dog to be released for a first impound is $45.00; the second impound fee is $60.00; every impound fee thereafter shall increase by $30.00 per occurrence. Any dog not claimed and redeemed, as provided herein within 3 business days from the impoundment, shall be humanely destroyed or adopted.
(b) A statement will be sent to the owner, custodian, and/or the individual who leaves the dog(s) at the pound that the dog(s) will be either euthanized or taken to a local adoption center. Along with the statement will be an itemized amount owed to the City pursuant to this Article to be paid within thirty (30) days. In the even said amount is not paid within thirty (30) days, then said fees/amounts will be added to the owner, custodian, or individual’s water bill and listed as “kennel fees”. A daily kennel fee in the amount of $12.00 per day will be added after the 3 business days expires until the dog is no longer in the pound in an amount not to exceed $120.00; in the event the dog is destroyed then an additional euthanization fee will be assessed.
(c) Euthanization Fee: In the event a dog is euthanized, the fee for such euthanization is set in the amount of $75.00 and shall be assessed against the owner/possessor of the dog.
(d) Court Convictions & Kennel Fee/Euthanization Fee: In the event a dog is impounded for a violation of this Chapter or for an offense listed in the Uniform Public Offense Code pertaining to dogs (such as an offense for animal cruelty), and in the event of conviction of the owner/possessor of said dog(s), the Court shall order the appropriate impound fee, rabies deposit (if applicable), euthanization fee if the dog is ordered to be euthanized, and a daily kennel fee in the amount of $12 per day commencing on the 4th day of impoundment. In such a situation where a conviction occurs, there shall be no limit to the kennel fee amount.

The City of Satanta, Kansas, shall maintain a Municipal dog pound that shall provide a clean, safe and secure place of impoundment for all animals seized and impounded under the authority of this article or the order of the City Health Officer or any other agency having authority over the impoundment of animals. It shall be unlawful for persons to trespass upon or within the area designated as the Municipal dog pound; to release any animal held therein; or to in any way impede or interfere with the enforcement of the ordinance or with the impoundment or custody of any animal confined in said pound.

It shall be unlawful for any person owning, harboring, keeping, or having the permanent or temporary custody or possession of any dog, to cause or allow such dog to:
(a) Be off the owner’s or custodian’s real property or personal property without being on a leash;
(b) Commit any damage or nuisance upon the property of any other person or the city;
(c) Disturb the peace and quiet of any persons; and
(d) Be within the City limits after being more than 3 months of age and not be vaccinated for rabies.

Nothing in this article shall be construed as preventing or prohibiting the City from impounding any animal suffering, or believed to be suffering, from a dangerous disease, or one that endangers the lives of persons. Such animals may be seized and impounded upon the order or at the discretion of the City Health Officer, or the governing body of the City of Satanta or any other Law Enforcement Agency.

Any person having custody of, possession of, or who is keeping or harboring a dog within the corporate limits of the City of Satanta, Kansas, for three consecutive days, or more, shall be deemed the owner of the dog required to license the dog.

(a) Any person violating any of the provisions of this article shall, upon proper charge and conviction thereof, be fined a sum not less than One Hundred Dollars ($100.00) and not to exceed Five Hundred Dollars ($500.00), or shall be imprisoned for a term not to exceed ninety (90) days, or both such fine and imprisonment. The penalties herein are exclusive of and may be imposed in addition to any fee paid by the owner of an impounded dog to the City for impound fee, fennel fee, euthanization fee, and rabies deposit fee if applicable (see 2-105(d)).
(b) If an owner is given a citation for a violation as discussed in sections 2-101:103 of this Article, then the owner shall have three (3) business days from the impound date of the dog to remedy the violation. In order to remedy the violation, the owner shall pay the corresponding fee, provide proof to the City, and further pay any additional fees as contained in 2-105. In the event the owner takes such action then the citation will be immediately dismissed.
