No household wastes, construction materials, processed materials, dead animals, building materials, etc., shall be burned at any time in the city.

This article shall not be construed to prohibit the burning-off of dry grass or natural vegetation. Natural vegetation shall include but not be limited to branches, grass, tumbleweeds, or leaves. The burning of the same under this section shall be permitted at the discretion and expressed authorization of the Haskell County Sheriff’s Department or the City of Satanta Fire Chief.

Bonfires for pep rallies and other special occasions shall be permitted at the discretion and express authorization of the Haskell County Sheriff’s Department or the City of Satanta Fire Chief specifically noting time, place, and duration.

A fire may be built in any portable burner for the purpose of cooking food including but not limited to outdoor stove, oven, fireplace, chimineas, or barbecue pit: provided, that such unit shall be solidly enclosed on all sides and the top surface shall be covered in a material such as wire mesh sufficient to contain any burning embers and ash. Any fire so started shall be extinguished and made safe before the persons starting and maintaining the same shall leave the place where the fire was started.

Burning of any material shall not occur when wind speeds exceed fifteen (15) miles per hour (mph). Fuel for a recreational fire shall consist only of seasoned dry firewood (dried at least six months) to minimize the generation of air contaminants. The term “recreational” shall be interpreted to mean an outdoor fire burning materials other than rubbish where the fuel being burned is not contained in an incinerator, outdoor fireplace, portable outdoor fireplace/pit, and barbeque grill or barbeque pit.

Any person violation any of the provisions of this article shall, upon conviction thereof, be fined in any sum not exceeding $500.00, or be imprisoned not to exceed 30 days, or be both so fined and imprisoned.

No person shall leave any fire unattended until appropriate precautions have been taken to prevent the fire from spreading. No person shall set a fire without first taking precautions to insure that the fire will be safely contained within the perimeters of the area sought to be burned and will present no danger to the health or property of adjoining landowners. Said person shall follow all City of Satanta guidelines and rules as set by state law and regulations.

The Satanta City Council reserves the right, at any time that the weather dictates, to ban open burning by ordinance; the Satanta City Council approves and support by this article, the practice of the Satanta Fire Chief, or his or her designate, declaring a No Burn Order for a particular day when it is determined through the use of one or more of the following conditions, (The NWS Rangeland Fire Danger Index, Weather conditions for the day, Ground moisture condition, Vegetation condition or Wind conditions), that burning should be prohibited. This decision will be made by the Satanta Fire Chief, or his or her designee, no later than 9:00 a.m. on any day conditions warrant a No Burn Order. The Fire Chief or his designate will notify the Haskell County Sheriff’s Office and Haskell County Emergency Management of the No Burn Order. It should also be noted that currently Haskell County has in effect the requirement that all burns in the county must be called into the Haskell County Sheriff prior to the start of any controlled burn.

(a)   Any person who abandons a fire that has not been extinguished, who fails to take proper precautions to control a fire, who burns on a day when burning is banned by the Satanta City Council or determination of the Satanta Fire Chief, or designee, or who otherwise violates the provisions of this article by issuance of a citation by the Fire Marshall or by an authorized law enforcement officer, or by the filing of a citation by the City prosecutor. A fine of not to exceed five hundred dollars ($500.00) per violation may be assessed against a violator of this resolution upon conviction.

(b)   Any person convicted of violating this article may also be assessed all costs incurred by any fire department, including any fire department called to assist the Satanta Fire Department, in the fighting of fires within the City of Satanta, Kansas, resulting from actions contrary to the mandates of this article and upon which the violation has been convicted.
